This facet of the case highlights the complex interplay between mental health and criminal culpability, raising fundamental questions about the ethics and efficacy of capital punishment.

• Mitigating Factor:

Mental illness can serve as a mitigating factor in sentencing, as it may impair an individual's capacity to appreciate the wrongfulness of their actions or conform their conduct to the law. In Carter's case, the Supreme Court recognized the significant impact of his mental illness on his culpability, ultimately deeming him ineligible for the death penalty.

• Nexus to Intellectual Disability:

Mental illness and intellectual disability often co-occur, and their combined effects can further diminish an individual's culpability. The Supreme Court acknowledged this nexus in Carter's case, considering his mental illness as an additional factor supporting his ineligibility for execution.

• Implications for Capital Punishment:

The consideration of mental illness in capital cases has profound implications for the future of capital punishment. Cruel and unusual punishment: The Eighth Amendment prohibits the government from inflicting cruel and unusual punishment.

• Shock the conscience

The Eighth Amendment further prohibits punishments that shock the conscience of society. This standard is highly subjective and varies over time, but it generally refers to punishments that are so extreme or degrading that they violate our sense of humanity. The Supreme Court has held that the death penalty can be cruel and unusual punishment in certain cases, such as when it is applied to individuals with severe mental illness.
